Supreme Court Clarifies Seniority Rules for Government Employees Transferred on Medical Grounds

The Supreme Court held that a government employee transferred at their own request (here, on medical grounds) cannot retain original seniority in the new post. The respondent, a Karnataka nurse turned clerk in 1989, had consented to junior status but later challenged her 2007 seniority list. The Court clarified that such transfers, unlike public interest transfers, reset seniority as per Rule 6 of the Karnataka Government Servants (Seniority) Rules, 1957. The appeal was allowed, upholding the 1989 seniority date.
