Supreme Court Rejects Plaint in Will Dispute as Time-Barred
The Supreme Court overturned a High Court order, ruling that a suit challenging a Will and Codicil was barred by limitation. The plaintiff, Hitesh P. Sanghvi, filed the suit in 2017, claiming the documents were null and void. However, the Court noted he knew of the Will by November 2014, making the 2017 filing exceed the three-year limit under Article 58 of the Limitation Act. The bench emphasized that limitation runs from the first cause of action, dismissing arguments about “full knowledge.” The plaint was rejected under Order VII Rule 11 CPC, ending the family legal battle over inheritance.
