Supreme Court Revives Criminal Case Against KIA Parts Supplier’s Ex-CFO in Rs. 10 Crore GST Fraud
The Supreme Court overturned the Karnataka High Court’s quashing of criminal proceedings against Moon June Seok, former CFO of Daechang Seat Automotive, in a Rs. 10.18 crore GST fraud case. The Court found prima facie evidence linking him to alleged misappropriation through identical cash receipts of Rs. 1.8 crore from co-accused Nikhil Kumar Singh. The bench emphasized that High Courts shouldn’t conduct “mini-trials” under Section 482 CrPC when chargesheets disclose cognizable offenses. The case involves alleged diversion of GST payments to shell companies. The trial will now proceed before Bengaluru’s III Additional Chief Metropolitan Magistrate.
